Terms of Service

1. Acceptance of terms

WhizzTalk is a product of WhizzAct Private Limited ("WhizzAct", "we", "us"), a company incorporated in India. By creating an account or using WhizzTalk, you enter into an agreement with WhizzAct Private Limited on these Terms of Service. If you're using WhizzTalk on behalf of a business, you're confirming you have authority to bind that business to these terms.

2. What WhizzTalk provides

WhizzTalk is a platform for building and hosting chatbot conversation flows and embedding them on your own website via a widget. Each plan has limits on the number of businesses, monthly conversations, team members, and stored images — see the pricing page for current limits.

3. Your responsibilities

• You're responsible for the content of the chat flows you build, including any claims, pricing, or recommendations your bot presents to visitors.
• You're responsible for keeping your account credentials and any AI provider keys you connect secure.
• You won't use WhizzTalk to collect sensitive personal data beyond what's needed for your stated purpose, or to send unsolicited messages via the OTP/verification channels.
• You'll comply with applicable law regarding data you collect from your own site's visitors through your embedded widget.

4. Plans, billing, and quotas

The Free plan is available with the limits shown on our pricing page. Paid plans and their limits are described at signup and in your billing settings. Prices are in Indian Rupees and are billed for the plan period through our payment gateway; WhizzAct does not store your card or bank details. A paid plan runs for the period you paid for; when and how we refund is set out in our Refund & Cancellation Policy. Downgrading a plan never deletes existing data — it only blocks creating new businesses or uploads over the new plan's limit.

5. Service availability

We aim for high availability but don't guarantee uninterrupted service. We may perform maintenance, and we'll try to minimize disruption when we do.

6. Termination

You may stop using WhizzTalk and request account deletion at any time. We may suspend or terminate an account that violates these terms, abuses shared resources (like the shared AI key or OTP quota), or is used for unlawful purposes.

7. Limitation of liability

WhizzTalk is provided "as is." WhizzAct is not liable for indirect or consequential damages arising from your use of the platform, including decisions made based on chatbot recommendations you configured. Where liability cannot be excluded, it is limited to the amount you paid us for the plan period in which the claim arose.

8. Intellectual property

WhizzTalk — including the platform, the embeddable widget, and the WhizzTalk and WhizzAct names and logos — is owned by WhizzAct Private Limited. You keep ownership of the content you create: your flows, questions, recommendations, uploaded images, and the chat data your own widget collects. You grant us only the limited licence needed to host and operate the service for you.

9. Governing law

These terms are governed by the laws of India, and the courts having jurisdiction over WhizzAct's registered office will have exclusive jurisdiction over any dispute arising from them.

10. Changes to these terms

We'll update the date at the top of this page when these terms change. Continued use after a change means you accept the updated terms.
